TERMS AND CONDITIONS OF LES BELGES

The consumer has the right to notify Les Belges that they renounce their purchase without penalty and without providing a reason, within 14 days from the day following the delivery of the product.

Article 1: General provisions

The online store Les Belges, a BV with registered office in Laakdal (Belgium), Averboodse Baan 66, VAT BE1015851009, (hereinafter 'Les Belges') offers its customers the opportunity to purchase products from Belgian designers online. These General Terms and Conditions ("Terms") apply to all items in the range and any purchase made by the customer from Les Belges. The customer accepts that these Terms will exclusively apply, to the exclusion of their own general or specific (purchase) terms, even if they stipulate that they apply exclusively.

Article 2: Price

All prices listed are inclusive of VAT and other taxes borne by the customer. If transportation, reservation, or administrative costs are charged, this will be stated separately. The price quoted refers only to the items described literally. Any accompanying photo is for decorative purposes and may contain elements or items not included in the price.

Article 3: Offer

Each offer is valid only for customers residing in the European Union. The items are exclusively intended for normal private use. Although the catalog and website are compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. If you have specific questions about sizes, colors, availability, delivery time, or delivery method, please contact our customer service in advance (see Article 12). Les Belges is only bound by a best-efforts obligation with regard to the accuracy, timeliness, or completeness of the information provided. Les Belges is in no way liable for material errors, typographical errors, or printing errors. The offer is valid as long as stock lasts and can be adjusted or withdrawn at any time by Les Belges. Les Belges reserves the right to refuse orders without providing reasons, adjust delivery times, split deliveries, or impose other conditions on the delivery.

Article 4: Online purchases

Customers can purchase items from the Les Belges range online. The purchase is concluded when the customer confirms their purchase during the ordering process. Items are delivered to the address specified in the confirmation email. Customers can choose between the following payment methods: credit card, debit card, or bank transfer.

Article 5: Delivery and execution of the agreement

Items ordered through this online store are delivered in Belgium, the Netherlands, Algeria, Andorra, Argentina, Armenia, Australia, Bahrain, Brazil, Bulgaria, Canada, Canary Islands, China, Cyprus, Denmark, Germany, Estonia, Finland, France, Greece, Hungary, Hong Kong, Ireland, Iceland, Italy, Japan, Jordan, Kuwait, Croatia, Latvia, Lithuania, Luxembourg, Malta, Morocco, Monaco, New Zealand, Norway, Austria, Poland, Portugal, Romania, Russia, Saudi Arabia, Singapore, Slovenia, Slovakia, Spain, Czech Republic, Tunisia, Turkey, United Kingdom, United States, South Africa, Sweden, Switzerland.

Delivery is carried out by bpost, dpd, ups, or dhl depending on the weight of the order and the destination country. We strive for the shortest possible delivery time, which may vary from 1 to 2 days within Belgium or up to a week for other countries. Prices depend on weight and destination and can be found during the checkout process. Unless otherwise agreed or expressly determined, goods are delivered to the customer's residence within 30 days of receipt of the order. However, we strive for the fastest possible delivery. Any visible damage and/or qualitative deficiency of an item or other shortcoming in the delivery must be immediately reported by the customer to Les Belges. The risk of loss or damage passes to the customer as soon as they (or a third party designated by them, who is not the carrier) physically possess the goods. However, the risk transfers to the customer upon delivery to the carrier if the carrier was commissioned by the customer and this option was not offered by Les Belges.

Article 6: Penalties for non-payment

Without prejudice to the exercise of other rights held by Les Belges, the customer is liable to pay interest of 10% per year on the unpaid amount from the date of default by operation of law and without prior notice. In addition, the customer is liable by operation of law and without prior notice to pay a flat-rate indemnity of 10% on the amount involved, with a minimum of 25 euros per invoice. Without prejudice to the foregoing, Les Belges reserves the right to take back items that have not been fully paid.

Article 7: Complaints

Any visible damage and/or qualitative deficiency of an item or other shortcoming in the delivery must be immediately reported to Les Belges under penalty of forfeiture of all rights. Les Belges has subscribed to the regulations of the UNIZO e-commerce label. These regulations are available at www.unizo.be/e-commerce where you can also address complaints or disputes through UNIZO's complaints procedure. You can also refer to the ODR platform (http://ec.europa.eu/consumers/odr/).

Article 8: Warranty

Legal warranty (only for consumers)
Under the law of September 21, 2004, concerning the protection of consumers in the sale of consumer goods, the consumer has legal rights. Each item is subject to the legal warranty from the date of purchase (if applicable, delivery to) the first owner. Any commercial warranty does not affect these rights.
General
To invoke the warranty, the customer must be able to provide proof of purchase. For items purchased online and delivered to the customer's home, the customer must contact Les Belges in advance, after which the customer must return the item at their expense to Les Belges. Any defect must be reported within 1 month of its discovery. After this period, all rights to repair or replacement lapse. The (commercial and/or legal) warranty never applies to defects arising from accidents, neglect, falls, abnormal or incorrect use, use of the item contrary to the purpose for which it was designed, failure to follow instructions or manuals, modifications or alterations to the item, rough handling, poor maintenance. It also does not apply to items with a shorter lifespan, or wear items. Defects manifesting after a period of 6 months following the date of purchase, if applicable delivery, are presumed not to be hidden defects unless the customer proves otherwise. The warranty is not transferable.

Article 9: Right of withdrawal

The customer has the right to withdraw from the contract within a period of 14 calendar days without giving reasons (except for custom orders at the request of the customer). The withdrawal period expires 14 calendar days after the day on which the customer or a third party appointed by the customer, who is not the carrier, physically acquires possession of the goods. To exercise the right of withdrawal, the customer must inform Les Belges, Ketelstraat 15, 3290 Diest,  info@lesbelges.com, through an unambiguous statement (e.g., written by post, or email) of their decision to withdraw from the agreement. The customer can use the withdrawal form provided for this purpose but is not obliged to do so. The withdrawal form can also be found in the returns and exchanges section. To meet the withdrawal deadline, the customer must send their communication concerning their exercise of the right of withdrawal before the withdrawal period has expired.

The customer must return or hand over the goods to Les Belges, Ketelstraat 15, 3290 Diest, without delay and in any case no later than 14 calendar days from the day on which they communicate their decision to withdraw from the agreement to Les Belges. The customer is on time if they return the goods before the period of 14 calendar days has expired. The direct costs of returning the goods are borne by the customer.

The customer is requested to return the items in their original condition and packaging, with all accessories provided, and instructions for use. If the returned product has diminished in value in any way, Les Belges reserves the right to hold the customer liable and claim compensation for any depreciation of the goods resulting from use of the goods by the customer that goes beyond what is necessary to determine the nature, characteristics, and functioning of the goods. All returned items are carefully examined. The starting point here is that the consumer may only inspect the item as they would be allowed to do in a shop. Returned items may be tried on, but not used. If an item has decreased in value due to the use of the customer, this will be charged to the customer.

If the customer withdraws from the contract, Les Belges will refund all payments received from the customer up to that point within a maximum of 14 calendar days after Les Belges has been informed of the customer's decision to withdraw from the agreement. For sales agreements, Les Belges may withhold the refund until it has received all the goods back, or until the customer has provided proof that they have returned the goods, whichever comes first. Les Belges will refund the customer using the same payment method with which the customer made the original transaction unless the customer has expressly agreed otherwise; in any case, no costs will be charged to the customer for such a refund.

Article 10: Privacy policy

Les Belges etc. BV undertakes to use your data exclusively for the execution of the concluded agreement that you enter into through your order and to provide you with unsolicited information from Les Belges. We treat your data as confidential information and will never pass it on, rent, or sell it to third parties. The customer is responsible for keeping their login details and password confidential. Your password is stored encrypted, so Les Belges does not have access to your password. Les Belges uses cookies. Cookies are a standard internet technology that allows certain information to be stored and unlocked on the user's system. Cookies cannot be used to identify individuals; a cookie can only identify a machine. Each internet user can set their computer so that cookies are not accepted. If your computer does not accept cookies, you may experience problems during the ordering process. If this is the case, we ask you to contact us so that we can still process your order. Les Belges keeps online (anonymous) visitor statistics to see which pages of the website are visited to what extent. Les Belges processes personal data in accordance with this privacy statement.
Purposes of processing: Les Belges collects and processes the personal data of customers for customer and order management (including customer administration, follow-up of orders/deliveries, invoicing, monitoring solvency, and sending marketing and personalized advertising).
Legal basis for processing: Personal data is processed based on Article 6.1.(a) consent, (b) necessary for the execution of an agreement, of the General Data Protection Regulation. To the extent that the processing of personal data takes place based on Article 6.1.a, the customer always has the right to withdraw the given consent.
Transfer to third parties: If necessary to achieve the intended purposes, the personal data of the customer will be shared with other companies within the European Economic Area that are directly or indirectly connected with Les Belges or with any other partner of Les Belges. Les Belges guarantees that these recipients will take the necessary technical and organizational measures to protect personal data.
Retention period: Personal data will be retained as long as your account remains active.
Right of access, rectification, erasure, restriction, objection, and data portability of personal data: The customer has the right to access their personal data at any time and can have them corrected if they are incorrect or incomplete, have them deleted, restrict their processing, and object to the processing of personal data concerning them based on Article 6.1 (f), including profiling based on those provisions. In addition, the customer has the right to obtain a copy (in a structured, commonly used, and machine-readable form) of their personal data and to have the personal data transmitted to another company. To exercise the above rights, the customer is asked to adjust the settings of their customer account themselves; and/or to send an email to info@lesbelges.com.
Direct marketing: The customer has the right to object free of charge to any processing of their personal data for direct marketing purposes.
Complaint: The customer has the right to file a complaint with the Data Protection Authority (Drukpersstraat 35, 1000 Brussels - commission@privacycommission.be).

Article 11: Invalidity - non-waiver

If any provision of these Terms is declared invalid, illegal, or null, this will in no way affect the validity, legality, and applicability of the other provisions. Failure at any time by Les Belges to enforce any of the rights listed in these Terms or to exercise any of these rights, will never be considered a waiver of such provision and will never affect the validity of these rights.

Article 13: Amendment of conditions

These Terms are supplemented by other terms where explicitly referred to and the general sales conditions of Les Belges. In case of conflict, these Terms prevail. Les Belges may change these Terms at any time without further notice. Any purchase after the modification implies acceptance by the customer of these new Terms.

Article 14: Evidence

The customer accepts that electronic communications and backups can serve as evidence.

Article 15: Applicable law - competent court

Belgian law applies, excluding the provisions of private international law regarding applicable law and the Rome I regulation regarding international sales contracts concerning movable property. In the event of disputes, only the courts in Antwerp, RPR Antwerp, division Turnhout, are competent.
